1. What these terms cover
These terms govern your use of this website and, where no separate written agreement applies, your use of software operated by Kothari IT Services Private Limited (“KIT”). Every client engagement is governed by its own written agreement; where these terms and a signed agreement differ, the signed agreement wins. The information on this site is provided to help you decide whether to start a conversation with us; it is not a contract, a quotation, or professional advice.
Claims about client work on this site are real but anonymized. We withhold client names by policy and share references in conversation, with permission.
2. Accounts and authorized use
Access to a KIT-operated system is provisioned per person, for the organization and purpose it was granted for. You are responsible for keeping your credentials to yourself and for what happens under your account; if you believe your credentials are compromised, tell us or your organization's administrator immediately. Accounts may not be shared, and access may not be extended to people or purposes it was not granted for.
3. Client-provided data
Data that a client organization or its users put into a KIT-operated system remains that client's data. The client is responsible for having the right to collect and use it; KIT processes it to provide and operate the system, as described in our Privacy Policy, and for no other purpose.
4. Third-party platforms and integrations
Some KIT software integrates with third-party platforms, such as the WhatsApp Business Platform, email providers, and hosting infrastructure. Your use of those features is also subject to the third party's own terms. Third-party platforms change on their own schedule; KIT maintains its integrations diligently but does not control, and cannot guarantee, a third party's availability or behaviour.
5. Intellectual property
The content of this website, and the software KIT builds and operates, are the intellectual property of KIT or its licensors, except where a written agreement says otherwise. Client data remains the client's. Using a KIT system grants the right to use it, not a licence to copy, resell, reverse-engineer, or build a competing service from it.
6. Service availability
KIT operates its systems with monitoring, backups, and human-gated releases, and works to keep them available. Maintenance windows, third-party outages, and faults still happen. Specific availability commitments exist only where a written agreement states them; this site makes none.
7. Acceptable use
Using this website or any KIT-operated system, you must not:
- Use it for anything unlawful, or to store or transmit unlawful content.
- Attempt to access accounts, data, or systems you are not authorized for.
- Probe, disrupt, or overload the service, or interfere with other users.
- Use messaging integrations to send spam or communications the recipient has not consented to receive.
- Misrepresent who you are or who you act for.
8. Suspension and termination
KIT may suspend or terminate access that breaches these terms, threatens the security of a system or its users' data, or is required to be suspended by law, acting proportionately: where it is reasonable to warn first, we warn first. Clients may end an engagement as their agreement provides.
9. Data at termination
When an engagement or account ends, the handling of data follows the written agreement that governed it: as a rule, client data is returned or exported in a usable form on request within the period the agreement sets, and then deleted from live systems, subject to the retention obligations described on our data deletion page. Nothing about termination transfers ownership of client data to KIT.
10. Liability
This website is provided as-is. To the maximum extent permitted by law, KIT is not liable for loss arising from reliance on the site's content or from circumstances outside its reasonable control. Liability in a client engagement is defined by that engagement's written agreement, not by this page.
